Terms of Service

These terms of use are entered into by and between You and Booking Bellhop(“Company,” “we,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Service”), govern your access to and use of bookingbellhop.com, including any content, functionality, and services offered on or through bookingbellhop.com, whether as a guest or a registered user.

Please read the Terms of Service carefully before you start to use Booking Bellhop. By using Booking Bellhop, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, found at bookingbellhop.com/privacy, incorporated herein by reference. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use Booking Bellhop.

Booking Bellhop is offered and available to users who are 18 years of age or older. By using Booking Bellhop, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use Booking Bellhop.

Booking Bellhop is a monitoring and notification tool. It checks publicly available Walt Disney World resort room availability and pricing and notifies you when a room matching your criteria becomes available or when its price changes. Booking Bellhop does not book, hold, or reserve rooms on your behalf, does not process Disney reservations, and cannot guarantee that any room or rate will remain available. All reservations and payments for Disney rooms are made by you, directly with Disney.

By placing an order with Booking Bellhop, You agree to pay the total price displayed during the checkout process. If order payment fails or is withdrawn after an order is created, You acknowledge that the order will be cancelled and no services will be provided.

Subscription plans are billed in advance on a recurring basis and automatically renew each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except as required by law. One-time purchases are non-recurring and expire as described at checkout.

If You create a watch with Booking Bellhop, You agree to receive notifications from Booking Bellhop about that watch. You agree to receive such notifications from the time the watch is created until the watch's end date. Notifications are sent by email and, if you have installed the app and granted permission, by push notification; Booking Bellhop does not send SMS text messages. You may disable notifications at any time by signing in and pausing the watch or turning off its alerts, or by adjusting your notification preferences in Settings. You acknowledge that notification volume will vary based on how often matching availability or price changes are found, and that you may not receive notifications if no matching room can be found.

You will only receive promotional messages from Booking Bellhop if You have opted in. You may opt out of promotional messages at any time via the unsubscribe link included in such messages, by logging in and opting out in your profile, or by contacting Booking Bellhop directly. Booking Bellhop user data and order data is never sold to any third parties for the purposes of promotions, sales, advertising, or similar.

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of Booking Bellhop thereafter. Your continued use of Booking Bellhop following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

We reserve the right to withdraw or amend Booking Bellhop, and any service or material we provide on Booking Bellhop, in our sole discretion without notice. We will not be liable if for any reason all or any part of Booking Bellhop is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Booking Bellhop, or the entirety of Booking Bellhop, to users, including registered users.

You are responsible for both:

• Making all arrangements necessary for you to have access to Booking Bellhop.
• Ensuring that all persons who access Booking Bellhop through your internet connection are aware of these Terms of Service and comply with them.

To access certain features, you sign in using a one-time code that we email to the address you provide. It is a condition of your use of Booking Bellhop that all the information you provide is correct, current, and complete. You are responsible for maintaining the security of the email account associated with your Booking Bellhop account, for keeping your sign-in codes confidential, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account or any other breach of security.

We have the right to disable any account or identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms of Service.

Booking Bellhop and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Service permit you to use Booking Bellhop for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on Booking Bellhop, except as incidental to normal use of the site through a web browser. You must not access or use for any commercial purposes any part of Booking Bellhop or any services or materials available through Booking Bellhop. Any use of Booking Bellhop not expressly permitted by these Terms of Service is a breach of these Terms of Service.

The Company name, the term “Booking Bellhop,” the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on Booking Bellhop are the trademarks of their respective owners.

You may use Booking Bellhop only for lawful purposes and in accordance with these Terms of Service. You agree not to use Booking Bellhop:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Booking Bellhop, or which, as determined by us, may harm the Company or users of Booking Bellhop, or expose them to liability.

Additionally, you agree not to:

• Use Booking Bellhop in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of Booking Bellhop.
• Use any robot, spider, or other automatic device, process, or means to access Booking Bellhop for any purpose, including monitoring or copying any of the material on Booking Bellhop.
• Use any device, software, or routine that interferes with the proper working of Booking Bellhop.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of Booking Bellhop, the server on which it is stored, or any server, computer, or database connected to it.
• Attack Booking Bellhop via a denial-of-service attack or a distributed denial-of-service attack, or otherwise attempt to interfere with the proper working of Booking Bellhop.

The information presented on or through Booking Bellhop — including room availability and pricing — is made available solely for general information purposes and may be inaccurate, incomplete, or out of date. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to Booking Bellhop, or by anyone who may be informed of any of its contents.

All information we collect on Booking Bellhop is subject to our Privacy Policy (bookingbellhop.com/privacy). By using Booking Bellhop, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

We do not accept any unsolicited ideas relating to our services from outside the Company, including suggestions about advertising, promotions, or changes to our services. If, notwithstanding this policy, you submit an unsolicited idea, you understand and acknowledge that such idea is not submitted in confidence, that we assume no obligation by considering it, and that we shall be free to use it without compensation or attribution to you.

Booking Bellhop's role is to provide a tool that monitors publicly available Disney resort availability and pricing information on your behalf. Booking Bellhop is not affiliated with, endorsed by, or sponsored by Walt Disney World, Disneyland, or Disney Enterprises, Inc., and does not provide, endorse, or guarantee any third-party product, service, or information. Booking Bellhop is not responsible for the products, services, reservations, pricing, or policies of Disney or any other third party. All bookings are made by you, directly with Disney, and are subject to Disney's own terms.

If Booking Bellhop contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any third-party websites linked to Booking Bellhop, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

YOUR USE OF BOOKING BELLHOP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH BOOKING BELLHOP IS AT YOUR OWN RISK. BOOKING BELLHOP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH IT REPRESENTS OR WARRANTS THAT BOOKING BELLHOP, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH IT WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT BOOKING BELLHOP WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, BOOKING BELLHOP, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, OR LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of Booking Bellhop.

All matters relating to Booking Bellhop and these Terms of Service, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of South Carolina without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or Booking Bellhop shall be instituted exclusively in the federal courts of the United States or the courts of the State of South Carolina, in each case located in Greenville, Greenville County, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Service in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

At the Company's sole discretion, it may require You to submit any disputes arising from these Terms of Service or use of Booking Bellhop, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying South Carolina law.

No waiver by the Company of any term or condition set out in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

The Terms of Service and our Privacy Policy constitute the sole and entire agreement between you and the Company regarding Booking Bellhop and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding Booking Bellhop.
